The Municipality is seeking public comments before making a decision on an application for an Official Plan Amendment and Zoning By-law Amendment – and we want to hear from you!
Proposed development
Bowmanville Lakebreeze Residence Ltd. has submitted applications for an Official Plan Amendment and a Zoning By-law Amendment for lands located at 301, 349 and 499 Port Darlington Road (Aquaview) in Bowmanville.
The proposed Official Plan Amendment seeks to increase the maximum building height from 8 storeys to 12 storeys and to obtain relief from Policy 9.4.5 e), which requires each condominium corporation block to have direct vehicular access to a public street without reliance on an easement through another condominium corporation.
The proposed Zoning By-law Amendment seeks to permit link townhouses in addition to the currently permitted apartment use, remove the maximum density limit of 120 units per hectare, and increase the maximum building height from 8 storeys to 12 storeys.
The proposal applies to two blocks (Blocks 16 and 17) within an existing plan of subdivision.
Block 16 proposes 239 apartment units within two buildings ranging from 6 to 7 storeys in height, with shared underground parking. The proposal also includes 24 townhouse units, up to three storeys in height, fronting Port Darlington Road. Vehicular access to both the apartment buildings and townhouses is proposed via a private lane from Port Darlington Road.
Block 17 proposes 309 apartment units within two 12-storey towers connected by a 4-storey podium, with two levels of underground parking. Vehicular access to Block 17 is proposed via a shared access through Block 16 to the east.
The total site area is approximately 3.54 hectares (8.74 acres).

In accordance with Section 22(7) 34(19) of the Planning Act, an appeal may only be filed by the applicant, the registered owner, Minister of Municipal Affairs and Housing, or a specified person or public body that has interest in the matter.
If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Clarington to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Clarington before the proposed official plan amendment is adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Clarington before the proposed official plan amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
